AZZUR TERMS AND CONDITIONSR

Scope


  1. The following general terms and conditions apply exclusively to all contracts concluded between Nakit Fashion GmbH, Berlin (hereinafter “AZZUR”) and the customer (hereinafter “customer”) on https://www.azzurberlin.comin the version current at the time the customer places the order.
    Contradictory, deviating, or supplementary general terms and conditions of the customer do not become part of the contract unless AZZUR expressly agrees to their validity.

    AZZUR sells only within Germany and Austria. Therefore, both the delivery and the billing address of the customer must be in Germany or Austria. The items are only sold in normal household quantities.

Conclusion of contract

  1. Customers can purchase goods in the AZZUR online shop as registered customers and via an access for which no login or registration is required. The registration is free of charge and can be canceled at any time, and there are no obligations on the part of the customer. The deregistration or termination takes place informally and directly by e-mail to info@azzurberlin.comor in writing to Nakit Fashion GmbH, Customer Service Online Shop, Schlüterstraße 51. 10629 Berlin Germany.

    The presentation of the goods does not constitute a legally binding offer, but a non-binding offer from AZZUR. The customer can select goods and place them in the shopping cart. By clicking on the button “Order with costs”, the customer places a binding order for the goods he/she has selected. Input errors can be corrected at any time before submitting the order. However, the order can only be placed if the customer has accepted these contractual terms by clicking on the “Accept Terms and Conditions” button. The receipt of the order is confirmed by an automated e-mail immediately after receipt of the order and does not yet represent acceptance of the contract by AZZUR. The contract is only concluded when the customer’s offer is made by a separate order confirmation by e-mail or by sending the accepts the ordered product. Acceptance can take place within three days of receipt of the offer.

Right of withdrawal

  1. Consumers have a 30-day right of withdrawal. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. You have the right to withdraw from this contract within 30 days without giving any reason. The cancellation period is 30 days from the day on which you or a third party named by you who is not the carrier took possession of the goods or if several goods that the customer ordered as part of a single order were delivered separately on which you or a third party named by you who is not the carrier took possession of the last goods.

    In order to exercise your right of withdrawal, you must inform Nakit Fashion GmbH, online shop customer service, Schlüterstraße 51. 10629 Berlin Germany, telephone number +49-30-88771234, fax no. 030-88771235, e-mail address: info@azzurberlin.com, by means of a clear statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached sample revocation form for this, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send the communication regarding your exercise of the right of cancellation before the cancellation period has expired. The right of withdrawal does not apply to contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery.

Consequences of revocation

 

If you revoke this contract, we shall immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged fees for this repayment. We can refuse the repayment until we have received the goods back or until you have provided proof that

You must return or hand over the goods to us immediately and in any case no later than 14 days from the day on which you inform us of the cancellation of this contract. The deadline is met if you send back the goods before the period of fourteen days has expired.

 

Please ensure that the item(s) are returned to us unused/unworn and with the appropriate labels/hangtags and the plastic item return seal. If the goods show signs of wear due to use, we are entitled to claim compensation. You only have to pay for any loss in value / replacement of the value of the product(s) if this loss in value is due to an examination of the condition, properties and functioning of the product(s) and the handling of them that was not necessary.

 

Exclusion of the right of cancellation

 

Unless the parties have agreed otherwise, the right of cancellation does not apply to the following contracts:

 

Contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,

 

Contracts for the delivery of goods that can spoil quickly or whose use-by date would soon be exceeded,

 

Contracts for the delivery of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed after delivery.

 

Contracts for the delivery of goods if these were inseparably mixed with other goods after delivery due to their nature,

 

Contracts for the delivery of alcoholic beverages, the price of which was agreed upon when the contract was concluded, but which can be delivered no earlier than 30 days after the conclusion of the contract and the current value of which depends on fluctuations in the market over which the entrepreneur has no influence,

 

Contracts for the supply of sound or video recordings or computer software in a sealed package if the seal has been broken after delivery,

 

Contracts for the delivery of books, newspapers, periodicals or magazines with the exception of subscription contracts.

 

Please note that the modalities mentioned in points 3.1 to 3.3 are not a prerequisite for the effective exercise of the right of withdrawal.

Availability of goods

 

  1. If the product ordered by the customer is temporarily not available, Nakit Fashion GmbH will immediately inform the customer of this fact in the order confirmation. In the event of a delay in delivery of more than two weeks, the customer has the right to withdraw from the contract.
  2. If it only emerges after the conclusion of the contract that the goods are permanently unavailable, Nakit Fashion GmbH will inform the customer of this immediately after this fact has become known by e-mail. In this case, both the customer and Nakit Fashion GmbH can withdraw from the contract.
  3. In the event of a withdrawal from the contract, Nakit Fashion GmbH will immediately reimburse the customer for payments already made.

Prices and shipping costs

 

  1. All prices quoted are total prices in euros. They contain the applicable statutory sales tax. The prices at the time of the order always apply. Any different prices for individual goods in the AZZUR branches (AZZUR) are generally non-transferrable for the online shop. Likewise, additional discounts or promotions – which may be granted or carried out in the branches – cannot be redeemed on the website https://www.azzurberlin.com.
  2. Shipping within Germany:
    The ordered goods are shipped via Mailboxes ETC or similar freight handler with the shipping method “standard shipping”, insured package. Shipping costs, including the applicable statutory sales tax, will be charged for shipping. This will be indicated upon check out. If a second shipment is required due to the availability of the goods, no additional shipping costs will be charged. We send the electronic gift cards by post with no shipping costs.
  3. When exercising the statutory right of withdrawal (see No. 3 of these General Terms and Conditions), the customer can return the goods. The cost to return the goods will be at the expense of the customer. It is not necessary to return gift cards. In the event of a corresponding revocation with naming of the voucher card number, these will be cancelled.
  4. International shipping to Austria:
    The ordered goods are shipped via Mailboxes ETC or similar freight handler with the shipping method “international standard shipping”, insured package. Shipping costs, including the applicable statutory sales tax, will be charged for shipping. This will be indicated upon check out. If a second shipment is required due to the availability of the goods, no additional shipping costs will be charged.
  5. When exercising the statutory right of withdrawal (see No. 3 of these General Terms and Conditions), the customer can return the goods. The return is at the expense of the customer. It is not necessary to return gift cards. In the event of a corresponding revocation with naming of the voucher card number, these will be cancelled.
  6. International Shipping Rest of the World:
    The ordered goods are shipped via Mailboxes ETC or similar freight handler with the shipping method “standard shipping”, insured package. Shipping costs, including the applicable statutory sales tax, will be charged for shipping. This will be indicated upon check out. If a second shipment is required due to the availability of the goods, no additional shipping costs will be charged. We send the electronic gift cards by post with no shipping costs.

Terms of Delivery

 

  1. The goods are only shipped within Germany and internationally to the rest of the world.
  2. The delivery times specified in the offer apply as delivery times, these begin with receipt of payment.
  3. We deliver the goods in accordance with the agreements made with you. Any shipping costs incurred are listed in the product description and are shown separately on the invoice.

Terms of payment, maturity of the purchase price

 

  1. The customer can choose to pay in advance (advance transfer), by immediate transfer (via Klarna-Sofort GmbH), by PayPal Plus or PayPal Express (via PayPal), by credit card VISA or MasterCard (via SIX Payment Services (Europe) SA). AZZUR reserves the right not to make individual payment methods available in individual cases or to refer to other payment methods. During the payment process, the customer must observe the additional general terms and conditions and data protection notices of the payment providers used (Klarna-Sofort GmbH, PayPal, SIX Payment Services (Europe) SA). By choosing the payment methods offered here, the customer agrees to the transfer of his personal data for the purpose of contract processing as part of his order. The customer’s right to object or

  3. In the case of purchase/payment by credit card, PayPal, the respective account is debited when the order is shipped.
  4. In order to be able to offer the customer attractive payment methods, AZZUR works together with the payment service providers Klarna (Sofort GmbH), PayPal, Amazon and SIX Payment Services (Europe) SA.
  5. If the contract is not concluded or is revoked, the purchase price that may have already been paid will be refunded immediately. Repayment is made to the account/payment method used by the customer for payment or transfer.

 

List of payment methods

 

PayPal Express / PayPal

  1. If you select the payment method PayPal – Express or PayPal in the ordering process, you will be forwarded directly to PayPal. There you log in with your PayPal user data, which is mandatory and authorize the payment. You will then be automatically logged out and redirected to the Nakit Fashion Online Shop.
  2. PayPal allows you to pay online and accept payments without sharing your banking information with the online shop. PayPal protects your personal information and your purchase. With PayPal Express or PayPal Plus you can use the payment and shipping information stored in your PayPal account to shop quickly, easily and securely. The PayPal Express Payment button is also located directly in the shopping cart. The debit depends on which payment method you have deposited and selected in your PayPal account. In the case of goods being returned, the amount will be credited to your PayPal account after receipt of the goods.

 

Direct debit … SEPA compliant (PayPal Plus)

  1. This is a payment service from PayPal Plus, which you can use as a customer without a personal PayPal account. You will be redirected to the PayPal page and approve a SEPA-compliant direct debit by providing your account details (IBAN, BIC). The invoice amount will be debited from your specified account. In the case of goods being returned, the amount will be credited to your bank account after receipt of the goods.
  2. Credit card (PayPal Plus)
  3. This is a payment service from PayPal Plus, which you can use as a customer without a personal PayPal account. You will be redirected to the PayPal site and authorize the payment of the invoice amount by selecting an appropriate credit card (VISA/MasterCard), disclosing the credit card number, the expiry date and the credit card security number. The invoice amount will be charged to your personal credit card. If you return goods, the amount will be credited to your credit card account after receipt of the goods. Please note that this process may take until the next payment run.

  5. Buy a new favorite item today and simply pay for it later within 30 days. This way you can take a close look at it before you pay for it.

  • After the purchase you will receive your payment information by email. You can conveniently pay for these on the Azzur Berlin website. By the way, you can also temporarily pause a payment if there is a problem.
  • If you want to return goods, you can easily mark your returns on the Azzur Berlin website to pause the invoice until the returns have been processed. Azzur Berlin updates your invoice as soon as the goods have arrived at the retailer.

Of course, you can also conveniently pay directly with VISA or MasterCard. Please note that the card must have a Card Validation Code (CVC), Card Verification Value (CVV), Card Security Code (CSC), or Card Verification Number (KPN) on the back of the card.

When paying with credit cards, please note that the billing address must match the cardholder’s details. All credit card transactions are processed by our payment provider SIX Payment Services (Europe) SA.

TRANSACTION PROCESS
Your card will only be charged after the goods have left our warehouse. We do not charge any transaction or additional fees.

PAYMENT SECURITY
To ensure the security of our customers when purchasing goods from the Azzur Online Shop, we use the industry standard “Secure Sockets Layer” technology (SSL). This serves to secure your personal data. In addition, credit card payments are subject to validation and approval by both the card issuer and Azzur for added security and to prevent fraud.

IN CASE OF RETURNS
If you return goods, the amount will be credited to your credit card account after receipt of the goods. Please note that this process may take until the next payment run.

In the event of goods being returned, the amount will be credited to the bank account used for payment after receipt of the goods. Please note that this process can take 3-5 working days, depending on the bank.   

 

 

 

Gift Vouchers / Gift Cards

  1. The customer can  purchase a gift card from AZZUR at azzurberlin.com.

    Gift cards can currently only be used in all sales outlets of AZZUR when purchasing products/goods. All branches are listed here:  https://www.azzurberlin.com/filialen-uebersicht . It is currently not possible to redeem gift cards in the online shop.

    The gift card balance cannot be paid out in cash.

    A Gift Card is considered redeemed when it has been offset against a purchase of Goods in a Store.
  2. Gift cards are excluded from discount campaigns.
  3. If you purchase a gift voucher, you will receive the gift voucher in electronic form with the purchase confirmation email and the associated invoice.

    With this gift voucher you can shop and pay in any AZZUR branch and in the AZZUR online shop – enter the voucher code in the voucher field when paying – and pay for the equivalent value. The gift voucher can be used multiple times up to the total value. Remaining credit remains on the gift voucher. The credit can only be offset against purchases. A repayment of the value credit is excluded. Please understand that if the voucher is lost, no replacement and no refund of the voucher value is possible.

    In the case of returned goods that were paid for with a gift voucher, the returned goods value = credit value is credited back to the gift voucher = original means of payment. A refund of the return value to another means of payment is not possible for EU legal reasons.

 

 

Retention of title; On Bill; Right of retention

  1. In the case of consumers, Nakit Fashion GmbH retains ownership of the purchased item until the invoice amount has been paid in full. If you are an entrepreneur exercising your commercial or self-employed professional activity, a legal entity under public law or a special fund under public law, Nakit Fashion GmbH retains ownership of the purchased item until all outstanding claims from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties.
  2. If the customer is in arrears with any payment obligations towards Nakit Fashion GmbH, all existing claims are due immediately.
  3. The delivered products/goods remain the property of Nakit Fashion GmbH until full payment has been made. The customer is not entitled to resell the goods delivered by us and still subject to retention of title without our prior written consent.

Warranty for defects, information on liability for defects

  1. In the case of contracts for the delivery of goods, the customer is entitled to the rights and claims under the statutory right to liability for defects. The statute of limitations for claims for liability for defects is two years from delivery for consumers and 12 months for entrepreneurs.
  2. Nakit Fashion GmbH is not liable for defects in the delivered goods that are caused by the goods being handled improperly or modified in a manner not approved by Nakit Fashion GmbH. The same applies in the event that the customer has not followed the instructions on the treatment and care of the goods (e.g. washing or drying instructions).

Liability

  1. We are liable for intent and gross negligence. Furthermore, we are liable for the negligent breach of obligations, the fulfillment of which is essential for the proper execution of the contract, the breach of which jeopardizes the achievement of the purpose of the contract and on the observance of which you as a customer regularly rely. In the latter case, however, we are only liable for the foreseeable, contract-typical damage. We are not liable for the slightly negligent breach of obligations other than those specified in the preceding sentences. The above exclusions of liability do not apply in the event of injury to life, limb or health. Liability under product liability law remains unaffected.
  2. Given the current state of the art, data communication via the Internet cannot be guaranteed to be error-free and/or available at all times. In this respect, we are not liable for the constant and uninterrupted availability of our online trading system

 

 

Data protection

  1. When initiating, concluding, processing and reversing a purchase contract, we collect, store and process data within the framework of the statutory provisions.

    When
    you visit our website, the IP address currently used by your PC, the date and time, the browser type and the operating system of your PC and the pages you have viewed are logged. However, it is not possible for us to draw any conclusions about personal data, nor is this the intention.

    The personal data that you give us e.g. when placing an order or by e-mail (e.g. your name and your contact details) will only be processed for correspondence with you and only for the purpose for which you have made the data available to us. We only pass on your data to the shipping company commissioned with the delivery, insofar as this is necessary for the delivery of the goods. In order to process payments, we pass on your payment data to the credit institute commissioned with the payment or the payment method processor.

    We assure you that we will not pass on your personal data to third parties unless we are legally obliged to do so or you have given your prior express consent. Insofar as we use the services of third parties to carry out and handle processing, the provisions of the GDPR are complied with.
  2. Duration of storage
    1. Personal data that has been communicated to us via our website will only be stored until the purpose for which it was entrusted to us has been fulfilled. Insofar as commercial and tax law retention periods have to be observed, the duration of the storage of certain data can be up to 10 years.

    8. according to Art. 18 DSGVO the right to request the restriction of the processing of your personal data, insofar as
    9. the accuracy of the data is disputed by you;
    10. the processing is unlawful but you oppose its erasure;
    11. we no longer need the data, but you need them to assert, exercise or defend legal claims or
    12. You have lodged an objection to the processing in accordance with Art. 21 GDPR
